1. Introduction

The Digital Millennium Copyright Act (DMCA) is a United States copyright law that was enacted on October 28, 1998. 2. Safe Harbor Provision

4. Counter-Notification

This counter-notification must include the user's physical or electronic signature, identification of the material that has been removed and the location at which the material appeared before removal, a statement under penalty of perjury that the user has a good faith belief that the material was removed as a result of mistake or misidentification, and the user's contact information. Upon receiving a valid counter-notification, The Service may restore the removed content within 10 to 14 business days unless the copyright owner files a lawsuit seeking a court order against the user.

5. Rights and Responsibilities

The DMCA establishes the rights of copyright owners and the responsibilities of OSPs. Copyright owners have the right to protect their works from unauthorized use and to seek redress for infringement. OSPs, on the other hand, must implement and maintain a policy for terminating the accounts of repeat infringers and must comply with the DMCA's notice-and-takedown procedures. Additionally, OSPs are required to provide a designated agent to receive notifications of claimed infringement, and they must inform users of their policies regarding copyright infringement.

6. Limitations of Liability

The DMCA provides limitations on the liability of OSPs for copyright infringement, provided they adhere to the safe harbor provisions.
